Terms of Sale

We try to keep the jargon to a minimum, and have written the below terms as simply as we could. Please read them carefully as they form the agreement under which we will supply customised wines to you.

Please contact us if you have any questions, before you purchase any products from us.

While we will make our best endeavours to deliver a high quality product within agreed timelines we cannot provide guarantees. We operate in good faith and will be as flexible as we can to make sure your wines are exactly what you hoped for.

Legislation

  • You must be over the age of 18 to order wine. By starting an order with us you declare you are over 18. You must not order products from us if you are under 18 years of age.
  • We will design the labels to comply with Australian domestic wine label requirements as defined by Wine Australia.
  • Once you receive the wines, you are responsible for ensuring they are only consumed by people over 18, and in a responsible manner. Please review your state's Responsible Service of Alcohol policies.
Quotes & Payments
  • Because our wine range and status varies, and quote we provide is only valid for 14 days unless we say otherwise.
  • A 50% deposit will be due when you agree to the quote, before we start work.
  • The remaining 50% payment is due before delivery. We can send photos of the completed wines as proof of completion, but will not post the wines until payment is made and received by our bank.
  • We maintain ownership of the wine until final payment is made. If the final payment is not made, you forfeit your deposit and the wines remain our property.
  • Payment of a deposit does not bind us to delivering the wines. We may choose to refund your deposit and not proceed for any reason.
  • If for any reason we agreed to deliver your wines before payment was received, and you do not pay, we may charge interest at a rate of 2% per month starting the day the wines were posted, and may commence debt collection after one month.
Timing
  • Delivery on certain date is not guaranteed. All timelines provided are just best estimates. It is your responsibility to allow enough time before an event to account for delays or breakages in transit.
  • We will not begin making your custom wines until the 50 per cent deposit has been received by our bank, and any timeline estimates we gave you will start from when the deposit is received.
Delivery
  • Delivery is via Australia Post
  • Estimates are provided at the time of ordering but we can't guarantee delivery times.
  • Any wine damaged in transit will be replaced or refunded (the choice will depend on timelines and extent of damage, and we'll discuss the options with you).
  • If you ticked 'Authority to Leave' when you ordered, you accept responsibility for the wines from when they are left by Australia Post.
  • Please ensure you can accept delivery of your wines! If your wine is returned to a Post Office, you are responsible for collection. If they are returned to us because you did not collect them, you will be required to cover the cost of re-delivery and we will not provide a refund if you choose not to cover the cost. We will keep your wines for 30 days after which date we may dispose or re-purpose them.
  • If you gave us an incorrect address, you are responsible for collecting the wines from the address you gave us, and/or for any re-delivery costs we incur as a result.
Dry Goods
  • Unless stated otherwise in the payment invoice, wine will be bottled in antique green glass in either claret or burgundy shaped bottled of the agreed size. Caps will be any of gold, black, ivory or brown screwcaps. Labels will be gloss wine stock, in the sizes provided on the website, and applied to the centre of the label panel of the bottle.
  • Customisation of dry goods is sometimes possible but may incur additional fees and/or time.
Product Quality
  • You will be asked to approve the label before we go to print. If you approved the label and then find an error in the content, or would like to make changes, you will be required to pay a fee if you want to make changes. The fee will cover our costs and time, and will depend on how far we've progressed with printing and applying your labels. If you choose not to pay this fee you are still liable for the final payment.
  • The colours of the labels may not appear exactly as they looked on-screen, as computer screens don't always match print results. If the exact shade is important to you, we can arrange to post printed samples to you before we apply the labels.
  • Refunds are not available if you don't like the taste of the wine. Samples can be provided (generally at a reduced cost) to taste the wines before you make a selection.
  • While we do our best to apply your labels perfectly, there is some unavoidable variation. Height variation within +-10mm, and/or skew within +-20deg is not considered a fault. Minor bubbling of labels can occur due to temperature/humidity variation and is not considered a fault.
  • The wines' expecting ageing time varies based on variety, bottle colour, bottle size and your storage conditions. If you intend to age your wines more than a year, please discuss ageing with us before you order.
Returns
  • Refunds or replacements are generally not available for change-of-mind because this wine was customised for you. A partial refund may be offered if we believe the wine can be re-sold, but this is at our discretion, and even if we do agree to a partial refund you are responsible for the cost of return freight.
  • Please inspect your wines as soon as you receive them. Storage conditions will affect both wine and label quality so fault claims reported after more than 30 days may not be considered reasonable, and you may not be entitled to a refund/ replacement.
  • If some wines are faulty, refunds will only be available for those wines, not for the entire batch.
  • You will be responsible for the cost of returning wine to us for any return, but we will refund that cost if the wines are found to be faulty.
  • Refunds or replacements for faulty wines will be processed after the wine has been returned. Photo evidence may be considered but that is at our discretion.
  • If labels are faulty, or damaged in transit, we may choose to post you replacement labels, along with instructions to replace them yourself, instead of returning the wines.
Use of imagery
  • Unless you tell us not to, we may use images of your labels and wines on our website, social media, or for other promotional activities.

These sale terms apply to all sales made from our website or by email. If you want to discuss any of these terms, please email or call us (rebecca@fernfieldwines.com.au, 0402 788 526).
